Do I need the candidate's consent to run a background check?+
In most cases, the legal basis is legitimate interest (Art. 6(1)(f) GDPR / berechtigtes Interesse) rather than consent — meaning you can start the check without the candidate's active involvement. However, we recommend informing the candidate and obtaining consent where feasible. Indicium can handle the consent process for you if desired.
